Democrats are utilizing the Ku Klux Klan Act to carry Trump and Giuliani accountable for the Capitol rebellion
Trump urged the march to the Capitol during his Save America rally on Jan. 6 and A riot followed in which Capitol Police officer Brian Sicknick was dead and was reportedly hit by a fire extinguisher. More than a dozen other police officers were injured; three people died in medical emergencies; and was a rioter shot when she tried to break through the Capitol.
Thompson, the NAACP, and Cohen Milstein Sellers & Toll cited the Ku Klux Klan Act of 1871, which "aims to protect against conspiracies through violence and intimidation to prevent members of Congress from performing their official duties".
The legal team stated in the lawsuit:
“The Capitol Rebellion was a direct, intended, and predictable result of the defendants' unlawful conspiracy. It was instigated under a joint plan the defendants have pursued since the November 2020 election that culminated in a gathering known as the "Save America" rally on January 6, 2021 on the Ellipse in Washington, DC and in which the Defendants Trump and Giuliani instigated a crowd of thousands to descend on the Capitol to use force to prevent or delay the counting of the electoral college's votes. As part of this unified plan to prevent the electoral college vote counting, Defendants Proud Boys and Oath Keepers acted jointly through their leadership to lead the Capitol attack amid the angry mob instigated by Defendants Trump and Giuliani , descended on the Capitol. The carefully staged series of events that played out at the Save America rally and the storming of the Capitol was no coincidence or chance. It was the intended and foreseeable culmination of a carefully coordinated campaign to intervene in the legal process required to confirm the vote in the electoral college. "
The NAACP, in its press release, quoted part of Giuliani's remarks at the Save America rally last month. "If we are right, many of them will go to jail. So let's try a fight. " unscrupulous Lawyer said. The NAACP also quoted the former president in their release. "So we're … going down Pennsylvania Avenue … We will … try to give them the pride and boldness they need to take our country back, ”Trump said at the rally.
1 hour before MAGA stormed the Capitol:

NAACP President and CEO Derrick Johnson said in a statement that Trump must be held accountable for "intentionally inciting and colluding with white supremacists to carry out a coup" as well as for "his continued efforts to disenfranchise African-American voters" . "The uprising was the culmination of a carefully coordinated, month-long plan to destroy democracy, block the results of a fair and democratic election, and disenfranchise hundreds of thousands of African American voters who cast valid ballots, "added Johnson. “Since our inception, the NAACP has gone to the courthouse to end actions that discriminate against African American voters. We are bringing this case forward now to continue our work of protecting our democracy and ensuring that nothing like what happened on January 6th ever happens again. "
Thompson called January 6 "one of the most shameful days in the history of our country" and added that "it was instigated by the President himself". "His joyful support of violent white supremacists led to a rupture of the Capitol, which put my life and that of my colleagues in great danger, ”said the congressman. “With the slightest luck, the result was no more fatal.
"While the majority of Senate Republicans have given up their responsibility to hold the president accountable, we must hold him accountable for the insurrection he has so obviously been planning," he added. "Otherwise this kind of authoritarianism will only be invited for the right-wing anti-democratic forces that are so anxious to destroy our country."
Rep. Thompson is also seeking punitive damages, who is trolling A + in that he could force Trump to admit he's a broken ass. pic.twitter.com/vQY3IpWn2I
